What Can Trigger a REAL Cal/OSHA Inspection?
A serious injury to an employee. This would include death, dismemberment (amputation or partial amputation), gross disfigurement, or eight hours or more of hospitalization for other than observation.
A complaint. Generally by an employee, former employee, customer, residential neighbor, business neighbor or even a competitor. Complaints are almost always anonymous and Cal/OSHA must follow-up with a visit.
Industry sweep. When Cal/OSHA detects a pattern in a particular industry, they will conduct random inspections throughout the industry.
Area Sweep. Cal/OSHA rotates geographical areas where they will conduct random inspections of selected business regardless of industry.
Abnormally high MOD rates. Cal/OSHA by mandate acquires records from workers compensation providers to monitor MOD rates. If your MOD rate exceeds 1.20 you will be flagged for inspection.
DON’T ASSUME YOU’RE IN COMPLIANCE |
